Welcome to Imbali Botanicals. These Terms and Conditions govern your use of our online store and the purchase of our handmade cosmetics products. By accessing our website and placing an order, you agree to be bound by these Terms. This agreement is compliant with the South African Consumer Protection Act (CPA), the Electronic Communications and Transactions Act (ECTA), and the Protection of Personal Information Act

(POPIA).

1. Nature of Products (Handmade Cosmetics)

Imbali Botanicals specialises in handmade, small-batch cosmetic and skincare products. Because our products are crafted by hand using natural ingredients, you acknowledge and agree that:

• Minor variations in colour, texture, scent, or appearance may occur between batches and do not constitute product defects.

• It is the customer's responsibility to review the ingredient lists provided on our packaging or website to avoid personal allergens.

• Products should be stored according to our instructions (e.g., away from direct sunlight and extreme heat) to preserve their natural shelf-life.

2. Exclusively Delivery-Only Operations

Imbali Botanicals operates strictly as an online e-commerce facility. We do not operate a physical retail storefront, and we do not offer customer collection or drop-off options at our production premises. All orders must be dispatched via our designated courier channel.

3. Delivery and Shipping Policies

All deliveries within South Africa are fulfilled via our logistics partner, The Courier Guy.

• Delivery Windows: Standard delivery typically takes 2 to 5 business days following order confirmation, depending on your regional location.

• Shipping Rates: Shipping costs are calculated dynamically at checkout based on delivery location and the volumetric weight of the package.

• Transfer of Risk: Risk of loss or damage transfers to you once the package is marked as successfully delivered at your nominated address by The Courier Guy.

4. Payment Infrastructure

Payment processing is securely facilitated externally by Stitch. Imbali Botanicals does not store, process, or have access to your raw credit card numbers or bank login credentials. By finalising your checkout transaction, you agree to comply with Stitch's terms of service.

5. Returns, Refunds, and Perishable/Hygiene Exclusions

In accordance with Section 42 of South Africa's ECTA and health and safety standard regulations regarding cosmetic goods:

• Hygiene Restrictions: Due to the intimate nature of skincare and cosmetics, products that have been unsealed, opened, or used cannot be returned or refunded under any circumstances for public health reasons.

• Transit Damage: If your cosmetics arrive broken, leaking, or damaged by the courier, you must notify us within 24 hours of delivery via email with clear photographic evidence. Approved claims will receive a replacement or store credit.

• Incorrect Items: If you receive an item different from your order confirmation, notify us within 48 hours. We will arrange a courier pickup of the unopened item and ship the correct item to you at no extra cost.

6. Limitation of Liability

Imbali Botanicals shall not be liable for any adverse skin reactions or unexpected allergies resulting from product use, provided all ingredients were accurately disclosed. We recommend patch-testing any new

handmade cosmetic product on a small area of skin before regular application.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or connected to these terms shall be subject to the exclusive jurisdiction of South African courts.
